EPF Nomination Rules — Spouse, Family Definition and What Happens Without One

A frequent HR query — can a married employee nominate only their children for PF and leave the spouse out entirely? Here's the exact legal position under the EPF Scheme, 1952.

If a member has a family (as legally defined), the nomination must go to one or more family members only — nominating a non-family person while a family exists is invalid. Since "spouse" is part of the statutory family definition, a married member can't bypass the spouse entirely by nominating someone outside the family — but they're not required to give the spouse any specific share. You can allocate 100% to children (also "family") and 0% to the spouse. Full freedom to nominate anyone — including a non-family person — exists only if the member genuinely has no family at all.

The Legal Basis — Para 61, EPF Scheme 1952

Para 61(2) — if a member has a family, the nomination shall be in favour of one or more family members. A nomination in favour of a non-family person while a family exists is invalid.

Para 61(3) — a member with no family at the time of nomination may nominate anyone, but this becomes invalid the moment a family is later acquired — a fresh nomination is then required.

How "Family" Is Defined (Para 2(g))

→ Male member — wife, children (married/unmarried, including adopted), dependent parents, and the widow and children of a predeceased son
→ Female member — husband, children, dependent parents, her husband's dependent parents, and the widow and children of a predeceased son
→ A male member can exclude his wife only by proving she's ceased to be entitled to maintenance under applicable law — and can restore her status with express written notice

e-Nomination on the Unified Portal

Filed digitally via UAN Member Portal → Manage → e-Nomination, with Aadhaar-linked OTP authentication and no employer signature required. No hard legal deadline exists for every member, but EPFO has made it a practical prerequisite for smooth passbook access and fast claim settlement.

What Happens Without a Nomination

PF dues on death go to family/legal heirs per the Scheme's definition — not a self-chosen person, and this can override a Will unless there's no family at all. Without a pre-verified nominee, the claim needs succession certificates, legal-heir certificates, and often an indemnity bond approved by the EPFO Regional Officer — stretching settlement from days to weeks or months.

HR Action Point

Make e-nomination filing part of onboarding and run an annual review. It's the single biggest factor in whether a family gets PF dues quickly during a difficult time.
