PF IW-1 Monthly NIL Return — Due Date, Process and Compliance Guide 2026
Every employer registered under the Employees Provident Fund Organisation is required to file a monthly IW-1 return for International Workers. But what if your company has no international workers at all? Do you still need to file? And what is the exact due date?
Here is the complete compliance guide for HR professionals and payroll teams.
What is the IW-1 Return?
IW-1 is a monthly return that employers in India are required to file with EPFO for their International Workers. An International Worker is a foreign national working in India with a valid work visa and employed by an Indian establishment covered under the EPF Act.
The IW-1 return must be filed through the EPFO Unified Portal and includes details such as names, nationalities, Universal Account Numbers of international workers who became EPF members for the first time during the preceding month, declarations in Form 2 furnished by qualifying international workers, and a list of international workers who left the employer's service during the preceding month.
What is the Due Date for IW-1 Return?
The IW-1 return must be filed within 15 days of the close of each month.
→ July 2026 wages — due by 15th August 2026
→ August 2026 wages — due by 15th September 2026
→ September 2026 wages — due by 15th October 2026
This applies to both active returns and NIL returns.
Is NIL Return Mandatory If You Have No International Workers?
This is where most employers are confused. Here is the clear position —
As per Paragraph 83 of the EPF Scheme 1952, the obligation to file the IW-1 return technically arises only when an establishment employs one or more International Workers. The law does not explicitly mandate a NIL return when no IWs are employed.
However the EPFO administrative circular dated 25th May 2012 introduces a broader expectation — that even establishments without any International Workers should file a NIL IW-1 return every month. EPFO has consistently stated that IW-1 return is mandatory for all covered establishments and in case there are no IWs a NIL return must be submitted.
The safe and recommended practice is to file NIL return by 15th of every month regardless. It takes less than 2 minutes on the EPFO Unified Portal and protects your establishment during EPFO inspections and audits.
Special Rules for International Workers — Key Points
→ International workers must contribute to EPF on their full salary — there is no ₹15,000 wage ceiling for IWs
→ IW PF contributions apply regardless of where the salary is paid — India or abroad
→ IW PF account remains active even if they leave India and no contributions are made in the intervening period
→ Inoperative account provisions do not apply to International Workers
→ Workers from countries with Social Security Agreements (SSA) with India who hold a valid Certificate of Coverage are exempt from mandatory EPF coverage
→ Contributions for IW may be withdrawn only on completion of 58 years of age unless covered under SSA
Countries with Social Security Agreements with India
Employees from countries that have signed a Social Security Agreement with India — including Germany, South Korea, Japan, France, Belgium, Switzerland, Denmark, Finland, Luxembourg, Czech Republic, Norway, Hungary, Austria, Canada, Australia, Sweden, Portugal, Brazil and Netherlands — may be exempt if they hold a valid Certificate of Coverage from their home country.
Penalties for Non-Filing
→ Late filing attracts interest at 12% per annum under Section 7Q
→ Penal damages from 5% to 25% depending on delay period under Section 14B
→ Up to 2 months delay — 5% damages
→ 2 to 4 months delay — 10% damages
→ 4 to 6 months delay — 15% damages
→ 6 months and above — 25% damages
→ Persistent default can lead to prosecution and imprisonment up to 3 years
Compliance Checklist for Employers
→ File IW-1 return by 15th of every month without fail
→ File NIL return if no international workers are employed
→ Verify Certificate of Coverage for any SSA country employees before exempting them
→ Ensure IW contributions are on full salary — no ceiling applies
→ Maintain updated records of all international workers including passport, visa, UAN
