Form 121 and PF Withdrawal — What the ₹50,000 / 5-Year Rule Actually Is

This question circulates constantly in HR groups — "Is Form 121 mandatory for PF withdrawal above ₹50,000 after 5 years of service?" We researched this carefully, and the framing itself is incorrect. Here's the accurate picture.

Form 121 is NOT a PF indemnity bond. It has nothing to do with a 5-years-of-service trigger. It's actually an Income Tax Department form.

What Form 121 Actually Is

Form 121 is officially the "Declaration under section 393(6) for receipt of certain incomes without deduction of tax" (Rule 211, Income-tax Rules 2026), notified under the new Income-tax Act, 2025, effective Tax Year 2026-27 (from 1 April 2026). It replaces Forms 15G and 15H with a single, unified no-TDS declaration for individuals of any age and HUFs whose estimated total income for the year is nil. CBDT tracks every filing with a mandatory UIN system (Notification No. 01/CPC(TDS)/2026, dated 28 March 2026).

It does genuinely cover PF — "accumulated balance due to an employee participating in a recognized provident fund" is one of the listed income types — but its purpose is avoiding TDS, not serving as security or indemnity.

The Real ₹50,000 / 5-Year Rule

→ TDS on EPF withdrawal applies (Section 192A) only if BOTH: withdrawal is before completing 5 years of service, AND the amount is ₹50,000 or more (raised from ₹30,000 since 1 June 2016)
→ TDS rate — 10% with PAN, 20% without PAN
→ No TDS at all if service is 5+ years, withdrawal is below ₹50,000, or it's a PF-to-PF transfer

Where Form 121 Fits In

An eligible member can submit Form 121 (from 1 April 2026) to avoid TDS even when the ₹50,000/under-5-years trigger applies — but only if their overall estimated tax liability for the year is genuinely nil. It's a simple self-declaration submitted to the payer — no stamp paper, no notarization.

If You Actually Need an Indemnity Bond

EPFO does use indemnity bonds/affidavits — but only in death-claim scenarios with no valid nomination on file, executed on state-appropriate stamp paper through the EPFO Regional Office. That's an unrelated, non-numbered document — not Form 121.
