ESIC Deduction — Gross Salary vs Basic+DA Under the Code on Social Security 2020

This one genuinely changed recently, so if your last answer was "gross salary," it's time to update it.

Historically, ESI contribution has been calculated on gross wages. But with effect from 21 November 2025, the Code on Social Security, 2020 replaced the ESI Act's broad "gross wages" concept with a narrower statutory wage definition under Section 2(88) — Basic pay + Dearness Allowance + Retaining Allowance, subject to an important 50% cap rule. ESIC operationalised this for employers via a circular dated 10 December 2025 (order dated 11 December 2025).

The Old Position — Gross Wages (ESI Act, Section 2(22))

Covered all cash remuneration under the employment contract — Basic + DA + HRA + City Compensatory Allowance + overtime + incentive/production bonus, and more. Employer PF contributions, conveyance allowance (per the Supreme Court's 2021 ruling in ESIC v. Texmo Industries), gratuity, and washing allowance were excluded.

The New Position — Basic + DA + RA, With the 50% Cap

Section 2(88) narrows "wages" to Basic + DA + Retaining Allowance. HRA, conveyance, overtime, bonus, and commission are excluded — but if the sum of excluded allowances exceeds 50% of total remuneration, the excess gets added back into "wages." Practical effect — employees on low-Basic, high-allowance structures (common to keep gross pay above the ESI ceiling) may find their statutory wages recalculated upward, pulling them back under ESI coverage even though gross salary exceeds the ceiling.

The Coverage Ceiling — What's Under Discussion

→ Current ESI wage ceiling — ₹21,000/month (₹25,000 for persons with disability), unchanged since 1 January 2017
→ A hike to ₹30,000 was discussed at a Labour Ministry meeting on 4 August 2026 — but as of this writing, NOT formally notified. ₹21,000 remains operative.
→ Contribution rates unchanged — 3.25% employer, 0.75% employee, since July 2019

Implementation Status Across States

All four labour codes were notified into force on 21 November 2025, and the Code on Social Security (Central) Rules, 2026 followed on 8 May 2026. But many aspects depend on individual states notifying their own Social Security Rules — rollout is uneven as of mid-2026. Verify your specific state's status before finalising payroll structures.
